The Laws on Site Clearance

Even when you didn’t cause any waste or damage yourself, clearing it is unfortunately your responsibility once it is on your land. That is why post-eviction clean-up needs to be handled properly. If waste is moved, dumped, or transferred incorrectly and someone is hurt as a result, you can still be held accountable for it according to law:

  • Environmental Protection Act 1990 (Duty of Care): Landowners and site managers have a responsibility to ensure waste is disposed of properly and in the right place, and they should keep a record of what was done. If it is fly-tipped elsewhere and traced back, you expose yourself to legal consequences.
  • Health and Safety at Work Act and Regulations (hazards and public safety): Sharps, human waste, gas canisters, and other dangerous items are a health and safety risk. If someone is injured or becomes unwell after returning to the site, liability can follow. That is why hazards need to be identified and removed before general clearance begins.
  • Controlled materials and hazard rules: Some items require specialist handling and cannot be disturbed without the correct controls. If we identify or suspect something like asbestos, we stop work in that immediate area and arrange appropriately licensed support. Compliance and safety always take precedence over speed.

Our Clean-Up Method

  1. Initial assessment: We attend to assess the site and plan the safest strategy. We consider what needs handling urgently, access points, and whether specialist support will be needed.
  2. Removal of the largest hazards: We deal with high-risk items across the site first, rather than clearing area by area. Hazards include sharps, contamination, gas cylinders, drug paraphernalia, asbestos, and anything else that could injure staff, contractors, or members of the public.
  3. Clear waste and abandoned items: Once the immediate risks are controlled, we gear ourselves up with equipment, including vehicles if needed, and start removing fly-tipped rubbish, debris, and abandoned belongings.
  4. Handle disposal correctly: During clearance, we make sure to segregate items into groups based on the safest and most sustainable disposal method. This makes it easy to scrap and recycle everything.
  5. Handover and documentation: Once clearance is complete, we will confirm it is safe to re-enter, provide full paperwork for your records, and flag any weak points that could expose you to reoccupation.
